Overview
Replacing the current Deprivation of Liberty Safeguards (DoLS), the Mental Capacity (Amendment) Act 2019 is expected to come into force from April 2023. The new system (expected to be referred to as the Liberty Protection Safeguards (LPS)) will cover care in a wider range of settings. NHS bodies, Local Authorities and Care Providers will all need to understand their new responsibilities and start preparing to implement the new system.Who is Preparing for the LPS (Liberty Protection Safeguards) aimed at?

This session will explain:-
- The main differences between DOLS and LPS
- Who will be responsible for authorising Deprivations of Liberty
- The assessments that will be required and what we know so far about who can do them
- What conditions need to be satisfied for an LPS authorisation to be granted
- How an LPS authorisation should be varied, reviewed and renewed
- How the arrangements are likely to work in different settings including independent and NHS hospitals, care homes, supported living settings and the community
- The new role: Approved Mental Capacity Professionals (AMCPs)
- Advocacy entitlements under LPS
- The changes to arrangements in an emergency
- The expected timetable for implementation
Participants will be provided with a clear overview of the changes and have the opportunity to discuss the implications with colleagues.
